Welcome to the WEST SNOWBOARDS website www.westsnowboarding.com and other affiliated websites (the “Website”). West Snowboarding Sàrl are after referred as (“WEST” or “we” or “us”) operates this Website pursuant to agreements with WEST.

Please review the following terms and conditions concerning your use of and access to the Website. By accessing, using and/or downloading any materials or content from the Website, you agree to follow and be bound by these terms and conditions (these “Terms” or this “Agreement”). If you do not agree with these Terms, you may not use the Website.

All features, content, specifications, products, technologies, colors and prices of products and services described or depicted on this Website are subject to change at any time without notice. Certain measurements and similar descriptions are approximate and are provided for convenience purposes only. We make all reasonable efforts to accurately display the attributes of our products, including the applicable colors. The actual color you see, however, will depend on your computer system and we cannot guarantee that your computer will accurately display such colors. The inclusion of any products or services in this Website at a particular time does not imply or warrant that those products or services will be available at any time. While it is our practice to confirm orders by email, the receipt of an email order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell a product or service. WEST is granting you a revocable, limited license, in compliance with these terms.

1.5 LICENSES FROM YOU

You grant to WEST and it’s Third Party Providers the non-exclusive, worldwide right to use, copy, transmit and display any data, information, Content or other Materials, provided to WEST by you in the course of accessing and/or using the Website. Notwithstanding the foregoing, WEST’s obligations regarding identification and other information concerning your personal information shall be governed by the terms of the Privacy Policy. The terms of the Privacy Policy are expressly incorporated herein as though set forth in full.

1.6 REPRESENTATIONS AND WARRANTIES

Each party represents and warrants that it has the power and authority to enter into this Agreement. WEST warrants that it will provide the Website and all goods and services in a manner consistent with its business practices, as WEST, in its sole and absolute discretion, deems fit. To the extent that you represent an entity of any type or any individual besides yourself, you represent and warrant that you have the proper authority to enter into this Agreement their behalf.

EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE BY WEST, THE MATERIALS ON THE WEBSITE ARE PROVIDED “AS IS,” AND ARE FOR USE AS CONTRACTED HEREIN. IN NO EVENT SHALL WEST OR THE THIRD PARTY PROVIDERS BE LIABLE TO ANYONE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY DAMAGES TO YOUR COMPUTER, TELECOMMUNICATION EQUIPMENT, OR OTHER PROPERTY, AND/OR FOR LOSS OF DATA, CONTENT, IMAGES, REVENUE, PROFITS, USE OR OTHER ECONOMIC ADVANTAGE, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO THE ACCESSING OR USE OF, OR INABILITY TO USE, THE WEBSITE AND THE SERVICES ASSOCIATED THEREWITH INCLUDING BUT NOT LIMITED TO THE DOWNLOADING OF ANY MATERIALS, REGARDLESS OF CAUSE, WHETHER IN AN ACTION IN CONTRACT OR NEGLIGENCE OR OTHER TORTIOUS ACTION, EVEN IF THE PARTY FROM WHICH DAMAGES ARE BEING SOUGHT OR THE THIRD PARTY PROVIDER HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATION OF LIABILITY SET FORTH IN THIS SECTION SHALL NOT APPLY IN THE EVENT OF YOUR BREACH, OR RELATED TO YOUR INDEMNITY OBLIGATIONS. THIS PARAGRAPH SHALL NOT AFFECT THE RIGHTS LISTED BELOW IN THE SECTION TITLED “INDEMNITIES”.

1.9 INDEMNITIES

You shall defend and indemnify WEST and its Third Party Providers against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) finally awarded against WEST or its Third Party Providers by a court of competent jurisdiction arising out of or in connection with a claim by a third party related to you. WEST shall have no indemnification obligation or other liability for any claim of infringement arising from (a) use of the Website and/or the goods, services or Materials associated with the Website other than in accordance with this Agreement; (b) the combination of the Website and/or the goods, services or Materials associated with the Website with any other products, services, or materials; or © any third party products, services, or materials.

1.10 YOUR RESPONSIBILITIES

You will comply with all applicable local, state, national and foreign laws, treaties, regulations and conventions in connection with your use of the Website, including without limitation those related to data privacy, international communications, and the exportation of technical or personal data from locations other than the location from which WEST controls and operates the Website and services associated therewith. Furthermore, you expressly agree not to violate any rights of publicity or privacy of any person, nor defame any person or entity.

1.11 MISCELLANEOUS PROVISIONS

Any action related to this Agreement will be governed by Swiss law. No choice of law rules of any other jurisdiction will apply. Any disputes, actions, claims or causes of action arising out of or in connection with this Agreement or the Website shall be subject to the exclusive jurisdiction of the cantonal and federal courts located in Vevey, Switzerland, and to arbitration as stated herein. This Agreement represents the parties’ entire understanding relating to the use of the Website and supersedes any prior or contemporaneous, conflicting or additional, communications. WEST reserves the right to change these Terms or its policies relating to the Website at any time and from time to time, and such changes will be effective upon being posted herein. You should visit this page from time to time to review the then current Terms because they are binding on you. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages of the Website, which may be posted from time to time. Your continued use of the Website after any such changes and/or postings shall constitute your consent to such changes. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed to reflect the intentions of the invalid or unenforceable provision(s), with all other provisions remaining in full force and effect. No joint venture, partnership, employment, or agency relationship exists between WEST and you as a result of these Terms or use of the Website. You may not assign this Agreement without the prior written approval of WEST. Any purported assignment in violation of this section shall be void. WEST reserves the right to use Third Party Providers in the provision of the Website and/or the goods, service and/or Materials associated therewith. The failure of either party to enforce any right or provision in this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by such party in writing. In the event of any litigation of any controversy or dispute arising out of or in connection with this Agreement, its interpretation, its performance, or the like, the prevailing party shall be awarded reasonable attorneys’ fees and expenses, court costs, and reasonable costs for expert and other witnesses attributable to the prosecution or defense of that controversy or dispute. Any and all rights not expressly granted herein are reserved by WEST.

1.12 INTELLECTUAL PROPERTY NOTICES

Elements of the Website are protected by copyright, trademark, trade dress and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound or image from the Website may be copied or retransmitted unless expressly permitted by WEST.

All WEST trademarks and/or other WEST identifiers referenced herein are trademarks of WEST and/or its affiliates, and may be registered in certain jurisdictions.

Ordering & Returns Policies

Part 2 of the General Terms and Conditions.

2.1 Payment Methods

We accept payment by PayPal, Visa, MasterCard and American Express. COD orders or debit cards are not accepted. We do not accept credit card numbers delivered by email. You should never send credit card numbers by email, as this is not a secure practice.

The billing address you provide must match the billing address that is on file with the financial institution that issued the credit card. If a credit card authorization fails, we reserve the right to cancel your order without notifying you. We cannot resolve credit card problems with your financial institution if a credit card is declined. It is your responsibility, as a consumer, to settle credit card problems with the issuing institution.

This store only accepts online orders. Orders cannot be placed by telephone, postal mail, email or Fax.

If you have issues using this website, your web browser might be outdated. We recommend using a recent version of Microsoft Internet Explorer (Edge), Mozilla Firefox, Chrome or Safari.

2.2 Shipping and Handling Charges

When you check out, you can view the shipping and handling charges for your order. In the rare case that shipping and handling charges exceed the amount shown, we will notify you.

Local Tax (V.A.T.) will be applied to your order if it is delivered to country outside of Switzerland.

We offers free shipping, but Tax as V.A.T. will be invoiced to you from your local Customs if it is delivered to country outside of Switzerland. Therefore, Local Tax (V.A.T.) for country outside of Switzerland are not mentioned in “Shipping” Costs.

2.3 Returning Merchandise

You can not return items, except in case of damages or defective items.

To initiate a return, contact WEST customer service at contact@westsnowboarding.com .

You have to notify us in writing within fourteen (14) days of delivery of the product.

The refund will be for the full value of the returned items, unless otherwise noted.

Shipping & return shipping and handling fees will not be refunded.

Credit for returned items will be applied to the credit method that was used to make the purchase. Returns will be applied to the purchasing credit card within 5 to 10 days of the date that the return is accepted by WEST.

If the return is due to defective products, inaccurate product descriptions, or an incorrect order, contact WEST customer service at contact@westsnowboarding.com to initiate the return. In these cases, you may be compensated for the return shipping.

2.4 Online Gift Cards

We may offer online Gift Cards for sale. Any Gift Cards purchased on this website can only be used to buy products on this website. They cannot be redeemed for cash, except as required by law. Gift cards cannot be reloaded.

If a Gift Card purchased on our website is lost or stolen, we will replace it with a Gift Card in the amount of the remaining balance, only if the purchaser’s Gift Card confirmation email and Gift Card # are provided to us as proof of purchase. To report your card as lost or stolen, contact WEST customer service at contact@westsnowboarding.com . 2.5 Sales Tax

Local Tax (V.A.T.) will be applied to your order if it is delivered to country outside of Switzerland. Local Tax (V.A.T.) for country outside of Switzerland are not mentioned in “Shipping” Costs and are generally invoiced by your local Customs.

2.6 Refunds, Credits and Balances Due

As soon as we receives and processes your return, we will notify you via email. Your credit card should be credited within 15 business days of the time that you receive this email. The return credit should be reflected on your statement within one or two billing periods, depending on your financial institution’s billing cycle.

2.7 Timing of Billing

Credit Cards: Your credit card is authorized at checkout. If this authorization is not successful you will be notified at checkout and can use another card or payment type. If authorization is successful, we then pass the order through a fraud and ID theft security system. If approved your order is processed and you will receive a confirmation email. If you have not received a confirmation email within 12 hours of placing your order please contact us at contact@westsnowboarding.com

2.8 Damaged and Defective Items

If an order arrives to you with obvious shipping damage, please refuse the delivery. If you have accepted delivery and then find shipping damage, please call the fulfiller immediately using the contact information included with the order. Please take pictures of any damaged packaging.

Please save all packaging material and paperwork for the order if shipping damage is a possible issue. If you dispose of packaging material or attempt to return the merchandise without contacting the fulfiller, you jeopardize our chances of making a claim, and you may not receive credit for the return.

A defective item is one that is inoperable but has no apparent damage. If you receive defective merchandise, please contact WEST customer service at contact@westsnowboarding.com .

2.9 Warranty Exclusions & Limitations

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM COUNTRY To COUNTRY. WEST’S MAXIMUM LIABILITY IS LIMITED TO INCIDENTAL DAMAGES NOT TO EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT. WEST DISCLAIMS AND EXCLUDES ANY LIABILITY FOR ANY CONSEQUENTIAL OR OTHER DAMAGES RESULTING FROM ANY REASON WHATSOEVER, MISUSE, AND DAMAGES RESULTING FROM USE OF THE PRODUCTS. THIS EXCLUSION AND LIMITATION APPLIES TO ALL LEGAL THEORIES UNDER WHICH DAMAGES MAY BE SOUGHT, AND WILL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. EXCLUDING THE LIMITED WARRANTY PROVIDED ABOVE, WEST AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESSED OR IMPLIED; AND NO WARRANTIES WHICH EXTEND BEYOND ANY MANUFACTURER SUPPLIED DESCRIPTION ACCOMPANYING THE PRODUCT. THE REMEDIES ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AGAINST WEST AND ITS AFFILIATES, REGARDLESS OF LEGAL THEORY. SHOULD A COURT FIND THIS LIMITED WARRANTY BREACHED, WEST’S ONLY OBLIGATION WILL BE, AT ITS OPTION, TO EITHER REPAIR OR REPLACE PRODUCT. SHOULD A COURT FIND THIS LIMITED WARRANTY TO HAVE FAILED OF ITS ESSENTIAL PURPOSE, WEST WILL REFUND TO YOU THE PRODUCT’S ORIGINAL PURCHASE PRICE.

2.10 Limits of Responsibility

We accept no responsibility for user-initiated damage and/or loss of parts incurred during operation or use of product.

2.11 Price and/or Description Changes

All prices, pictures, and descriptions on this website are subject to change. We maintain no responsibility for inadvertent errors. Please contact us regarding price or promotion discrepancies.

When you place your order with us, you agree to the price and terms indicated on this website. Price differences related to future or past prices in our store or any other store are not refundable.

2.12 Errors on Our Site

Prices and availability of products are subject to change without notice. Errors will be corrected where and when discovered.

If an item ordered is out of stock, you will receive an email detailing the item in question and how to proceed.

We reserves the right to revoke any stated offer, cancel orders, and to correct any errors, inaccuracies or omissions in any stated offer or price, including after an order has been submitted and whether or not the order has been confirmed and your payment processed.

If your payment has already been processed for the purchase when your order is cancelled, we will issue a credit to the payment method used in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account.

WEST (“WEST” or “we” or “us”) wants to hear from you! We love feedback, and we want to encourage user participation in our creative processes, but we get a lot of submissions, so we might need some time to reply to reply.

This may not include copyright ownership of images which you may upload, but does include an express license to use said images in any method WEST sees fit and make compilations and derivative works thereof in all media now known or hereafter devised. Except as expressly enumerated in the preceding sentence, by providing such Submissions to WEST, you agree to assign to WEST, as consideration in exchange for the use of the Website, all worldwide rights, title and interest in copyrights and other intellectual property rights to the Submissions. You represent that you have the right to grant WEST these rights. WEST shall be free to use and/or disseminate such Submissions on an unrestricted basis for any purpose. All Submissions must be true, and in accordance with the rights of privacy and publicity and all federal, state and international law. You may not upload an image or any likeness of another without their consent (or the consent of their parent or guardian if they are under the age of 18). If you do so, WEST reserves the right to cancel or suspend your account. Furthermore, WEST reserves the right to cancel or suspend your account, if in its sole discretion, it believes you are using WEST for improper purposes, or any purpose inconsistent with its business.

You will not post any Submission that (a) is defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person; (b) bigoted, hateful, or racially or otherwise offensive; © is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms or can reasonably be expected to harm any person or entity
